Karnataka High Court Clears Path for Bangalore University’s BCom Examinations

In a significant ruling, the Karnataka High Court has allowed Bangalore University (BU) to conduct its first, third, and fifth-semester Bachelor of Commerce (BCom) exams as per the original schedule, following a contentious dispute over date clashes.

Originally slated to start on January 13, the BCom exams faced a potential reschedule due to a January 10 ruling from a single judge bench. This ruling came after five students petitioned that the BCom exam dates overlapped with exams from the Institute of Chartered Accountants of India (ICAI), creating a scheduling conflict2.

However, a special division bench of the High Court, comprised of Justices Anu Sivaraman and M.I. Arun, overturned the earlier ruling in an urgent hearing on January 12. The court stated that rescheduling the exams for the benefit of five students would disrupt arrangements for around 35,000 candidates enrolled in the university’s BCom program2.

The advocate representing Bangalore University argued that the exam schedule had been announced well in advance, with official notifications issued on December 13, 2024. He emphasized that rearranging the examination timetable on account of a few students’ petitions was an unfeasible solution2.

The division bench, in its judgment, highlighted that scheduling of examinations is a policy decision under the university’s jurisdiction and should not be subject to judicial interference. They also noted that the petitioning students should have approached university officials with their concerns early on, rather than seeking judicial intervention at the 11th hour2.

Despite acknowledging the students’ concerns about the overlapping dates, the court ruled that the constitutional court doesn’t hold the power to reschedule exams, leaving that decision to the discretion of the university.

Consequently, the BCom examinations will proceed as scheduled on January 13, 15, 17, 20, and 21.

This landmark ruling underscores the intricate balance between accommodating individual student needs and managing the institutional logistics of a major university examination schedule.
